These Terms and Conditions govern:

  • Any marketing services provided by Zenith Creatives.


By using this website or engaging my services, you agree to these Terms.

These Terms should be read alongside the Privacy Policy available on this website, and any other services agreement entered into between you and Zenith Creatives.

PART A — WEBSITE TERMS

PART B — SERVICE TERMS

7. Services Provided

Zenith Creatives provides marketing consultancy services, including but not limited to:

  • Social media strategy and content planning

  • Local SEO services

  • Google Business Profile optimisation

  • Blog writing and keyword optimisation

  • Website content updates

  • Bespoke marketing packages


All services are delivered remotely unless otherwise agreed in writing.

8. Engagement and Commitment

All packages require a minimum three (3) month commitment.

This period allows sufficient time to implement strategy, build consistency, and assess results properly.

At the end of the three-month period, we will review performance and agree on future support.

9. Fees and Payment

Invoices are issued one week before the end of each month.

Payment is due within 5 working days of the end of each month.

Work may be paused if payment is not received by the due date.

Fees for the initial three-month commitment remain payable even if services are discontinued early, unless otherwise agreed or set out in a service agreement.

10. Scope of Work

The agreed scope of work will be confirmed in writing before services begin.

Any additional work outside the agreed scope must be approved in writing and may incur additional fees.

Zenith Creatives is not responsible for delays caused by:

  • Late approvals

  • Incomplete information

  • Restricted access to accounts

  • Delayed communication

11. Client Responsibilities

You agree to:

  • Provide accurate and timely information

  • Provide necessary access to platforms and tools

  • Review and approve content promptly

  • Ensure materials provided do not infringe third-party rights


You remain responsible for final approval of all published content.

12. Third-Party Platforms

Zenith Creatives is not responsible for:

  • Algorithm changes

  • Platform outages

  • Account suspensions

  • Policy changes by social media or search platforms


Platform performance is outside my direct control.

13. No Guarantee of Results

Marketing performance depends on many external factors.

While services are delivered with professional care and skill, Zenith Creatives does not guarantee:

  • Specific Google rankings

  • Specific enquiry volumes

  • Specific revenue outcomes

  • Specific follower growth


All services are provided on a best-efforts basis.

14. Data Protection

Zenith Creatives processes personal and business data only as necessary to deliver agreed services.

This may include access to:

  • Social media accounts

  • Google Business Profile

  • Website analytics

  • Customer enquiry data

  • Email marketing platforms


Zenith Creatives agrees to:

  • Process data securely and confidentially

  • Use data only for agreed service delivery

  • Not share data with unauthorised third parties

  • Comply with the UK GDPR and Data Protection Act 2018


Clients remain the data controller of their own customer data. Zenith Creatives acts as a data processor where applicable.

Clients are responsible for maintaining compliant privacy notices and data handling practices.

15. Confidentiality

Both parties agree to keep confidential any non-public business information shared during the engagement.

This obligation continues after services end.

16. Limitation of Liability

To the fullest extent permitted by law:

Zenith Creatives’ total liability for any claim arising from services shall not exceed the total fees paid for those services.

Zenith Creatives shall not be liable for:

  • Indirect or consequential loss

  • Loss of profits

  • Loss of business

  • Reputational damage


Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot legally be excluded.

17. Termination

After the initial three-month commitment:

  • Either party may terminate services with 30 days written notice.

  • Outstanding invoices remain payable.


Zenith Creatives reserves the right to terminate services immediately in cases of non-payment or serious breach of these terms or the service agreement agreed between you and Zenith Creatives

18. Informal Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve the matter through good faith discussion before pursuing formal legal action.

19. Entire Agreement

These Terms, together with any written proposal or agreement, form the entire agreement between the parties.

You acknowledge that you have not relied on any statement or representation not set out in writing.

Nothing in this clause limits liability for fraud or fraudulent misrepresentation.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Waiver

Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any future breach.

22. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

23. Changes to These Terms

Zenith Creatives reserves the right to update these Terms at any time.
